Terms of Use

This is a draft (minuta) of the MenoPro Terms of Use, pending legal review. It sets the rules for using the app and website. Last updated: [PREENCHER: effective date].

1. Acceptance

By creating an account or using MenoPro, you state that you have read and agree to these Terms and the Privacy Policy. If you do not agree, do not use the service.

2. The service and health notice

MenoPro provides wellness support and information about menopause. The content does not replace medical evaluation, diagnosis or treatment, and should not be used to decide on medication or care on your own. In an emergency, seek immediate care. In Brazil, call SAMU at 192.

3. Account and eligibility

The service is intended for people aged 18 or older. You must provide truthful information and keep your credentials secure, and you are responsible for activity on your account.

4. Acceptable use

You agree not to: - Violate laws or the rights of others. - Harass, offend or expose other people. - Post unlawful or misleading content, or content presenting medical advice as if professional. - Attempt unauthorized access to systems, or copy or exploit the service improperly. - Use the service for commercial purposes without authorization.

5. Subscriptions, payments, renewal and cancellation

Some features require a paid subscription, purchased through the Apple App Store or Google Play. Billing, automatic renewal and cancellation follow the store's rules, and you can cancel at any time in your store account settings. Refunds follow each store's policy. The right of withdrawal under art. 49 of the Brazilian Consumer Defense Code applies as provided by law [PREENCHER: confirm withdrawal right conditions].

6. AI assistant and limitations

The AI assistant may be wrong, inaccurate or incomplete. Use its answers as support, confirm important information with a healthcare professional, and do not use it in emergencies.

7. Community and user content

You are responsible for what you post and grant us a limited license to display that content in the service. We may moderate, remove content, and suspend or ban accounts that violate these Terms, without prejudice to legal measures.

8. Intellectual property

The app, brand, design, texts and code of MenoPro belong to Virex Tech or its licensors. We grant you a personal, limited, revocable, non-exclusive license to use it, with no right to copy, modify or resell.

9. Limitation of liability

To the extent permitted by law, the service is provided as is. We are not liable for health decisions made based on the content, nor for unavailability beyond our control. Nothing in these Terms excludes rights that consumer law guarantees you.

10. Suspension and termination

You may close your account whenever you wish. We may suspend or end access in case of breach of these Terms, fraud or legal requirement, with notice when possible.

11. Changes

We may change these Terms. We will notify you of material changes in the app or by email. Continued use after notice indicates agreement to the new version.

12. Governing law and jurisdiction

These Terms are governed by Brazilian law. The courts of the district of [PREENCHER: judicial district] are chosen, without prejudice to the consumer's home forum where applicable.
